In its affidavit, the CBI has alleged that Kejriwal is trying to make the case politically sensational whereas various courts have already taken cognizance of the case after satisfying themselves about his prima facie involvement in the crime. The CBI has said that the Delhi High Court, while dismissing Kejriwal’s writ petition, had said in its order that it cannot be said that the arrest of the petitioner was without any reasonable cause or illegal.

The CBI has said that the High Court had stated in its order that the Special Judge had followed due procedure in ordering Kejriwal’s arrest and remand. Kejriwal’s influence and clout is evident as he, as the Chief Minister, not only has influence over the Delhi government but as the AAP chief and national convenor, he also has influence over all relevant decisions and activities related to it. He has close nexus with officers and bureaucrats. If Kejriwal is released on bail, the trial of the case will be seriously and adversely affected as the case is in its initial stage and the testimony of key witnesses is yet to be given.

The CBI has said that as far as release on medical bail is concerned, it should be given only when treatment in jail is not possible. Because with regard to diseases, they can be treated properly in Tihar Jail Hospital or any of its referral hospitals as per the jail rules and manual. The CBI has said that Kejriwal is the kingpin of this scam.

Despite not being the minister of the Excise Department, he is the architect of the entire scam. He knew everything about this scam because all the decisions were taken under his consent and direction, despite this he is not giving satisfactory answers to the questions of the investigating agency.
